The Awarding Act: The Good Faith of the Awardee Extinguishes Evictions – Part I

The awarding act issued within a foreclosure procedure of a real estate asset is a document that enjoys a unique legal regulation, a regulation that in practice raises a series of legal interpretations, often diametrically opposed.

Given the complexity of this type of document, I have prepared a series of three informative materials.

In the first material, I present a series of theoretical and practical considerations regarding:
(i) the legal nature of the awarding act (civil legal act or another type of act),
(ii) the basis for extinguishing evictions directed against the awardee,
(iii) what is concretely meant by the extinguishing of evictions,
(iv) the date when the extinguishing of evictions takes effect.
