The adjudication act issued within the framework of a forced execution procedure of an immovable property is an act that enjoys a special legal regulation, a regulation that in practice raises a series of legal interpretations, very often diametrically opposed.
Given the complexity of this type of act, I have prepared a series of three informative materials.
In the content of the second material, I present a series of theoretical and practical considerations regarding:
(i) the condition of the good faith of the adjudicator, as retained in the practice of national courts,
(ii) the verification of the condition of good faith within an eviction action consisting of an action aimed at the reversal of forced execution.
