The act of awarding issued within the framework of a forced execution procedure of an immovable property is an act that enjoys a special legal regulation, a regulation that in practice raises a series of legal interpretations, often diametrically opposed.
Given the complexity of this type of act, I have prepared a series of three informative materials.
In the content of the second material, I present a series of theoretical and practical considerations regarding:
(i) verification of the condition of good faith in an eviction action consisting of an action aimed at the nullity of the act of awarding as a result of the annulment of the property act of the debtor executed,
(ii) verification of the condition of good faith in an eviction action aimed at real estate claims promoted by a third party,
(iii) verification of the condition of good faith in other eviction actions (e.g., action in simulation, action in usucapion),
(iv) justification of the increased protection of the awardee,
(v) conclusions.
