Through Law No. 87/2020, buyers of homes and/or household annexes, based on Law No. 112/1995, have been given the right to acquire ownership of the yards/gardens associated with the homes and/or household annexes.
In this regard, Article 27 of Law No. 18/1991 was amended to include the provisions of paragraph (2^3), which regulate the right to establish ownership for land designated as yards/gardens associated with homes purchased under Law No. 112/1995.
This legislative change is welcome and of utmost interest to the thousands of homeowners who purchased properties from Romanian state authorities, as they can now opt out of paying rent for the used land and choose to become owners instead.
Considering the legislative history and judicial practice, we have prepared an informative material on the conditions under which the right to own land can be acquired under Law No. 87/2020.
