The certificate of attestation of the right to private ownership is a document by which certain commercial companies justify their right of ownership over specific plots of land.
The nullity (illegality) of a certificate of attestation of the right to private ownership can lead a commercial company to the inability to prove its right of ownership over a plot of land, potentially generating a series of negative legal consequences (e.g., losing a lawsuit, halting pre-contractual negotiations, blocking a transaction, etc.).
In the second part of this material, I briefly present:
(i) the validity conditions for issuing certificates and their content from the perspective of the courts – continuation,
(ii) the legal remedies by which the validity of a certificate can be contested (annulment action, exception of illegality),
(iii) the time limits within which legal remedies can be exercised.
